Avvo Legal Guides Features Attorney Orlando Arellano and Principal David Ezra in New Column “New Law Offers Piece Rate Employers a Possible ‘Get Out of Jail Free’ Card”

Orlando Arellano and David Ezra penned a new column for Avvo Guides offer important tips for navigating compliance with the new piece rate law:

    •Become compliant – make sure your compensation system separately pays for rest break and non-productive work time.  Also make sure that those payments are shown separately on employees’ wage statements.

    •Make a payment to employees for past violations by the end of 2016.  The statute provides employers to pay the actual damages or a more general liquidated damage rate of 4% of the employees’ income during the time period from July 1, 2012 to December 31, 2015.

    •Give notice to the Department of Industrial Relations by July 1, 2016 that your company is taking advantage of this affirmative defense and complying with the required procedures. Read More…
