You Can Handle the Truth – and cooperate-with-insurers-examinations-under-oath-published-in-reuters-westlaw-today

Berger Kahn Partner Erin Mindoro Ezra, and Senior Associates Mallory Yumol Schorr and Miles J. Dawson, were recently published in Reuters and Westlaw for their article “You can handle the truth — and cooperate with insurers’ examinations under oath.” They explain what an examination under oath (or “EUO” for short) is, the duty to cooperate, and possible ramifications if insureds or their lawyers fail to cooperate with the EUO or claim investigation generally.

Insurers use EUOs to investigate and obtain more information needed to process claims.  Cooperation with the claim investigation is often a prerequisite to receiving coverage benefits under the policy.  The article encourages insureds and their lawyers to work with insurers to substantiate their claims by providing EUOs, requested documents, and other information.
