Since the arrival of Bird Rides in 2017, electric scooters have become increasingly popular. Other companies, such as Lime and Lyft, now line streets across the United States with their scooters. With smartphone apps being the only requirement for access, these scooters have intoxicated the public. This rising popularity is accompanied by rising risk of damage or serious injury.
On June 20, 2024, in their article “Will You Scoot By On Coverage? The Uncertainty Of Insurance For Electric Scooters” Berger Kahn attorneys Erin Ezra, David Ezra, and Walker Macon examined the gray area of insurance coverage that surrounds electric scooter use. Erin, David, and Walker discussed the language in auto policies and homeowners policies that may prevent a scooter accident from being covered under the rider’s own insurance policies, as well as the current lack of coverage available through companies that provide publicly available scooters.”
