Berger Kahn Managing Partner Craig Simon Can Provide Expert Insurance Law Analysis

IRVINE, CA–(Jan 16, 2012) – With the largest maritime disaster, the losses related to the Concordia sinking and its related impact on Carnival Corporation’s stock price, Berger Kahn Managing Partner Craig Simon is available to provide commentary to media on the implications of this disaster and how insurance will play a role in the disaster.

The parent corporation for Carnival has insurance coverage, but there is a $30 Million deductible for the ship damage, and $10 Million deductible for injury claims.

Just what caused this disaster? Was it all pilot error, or were their defects in the shipbuilding design or manufacturing that contributed to the ship’s sinking? The answers to those questions will impact whether Carnival will be able to recover some of the money it lays out personally to resolve claims and whether the insurance companies paying out millions or billions will be able to recoup their losses under a process called subrogation.

Simon has worked on court cases involving claims in the billions, including the San Bruno gas explosion and the fires of 2007 in San Diego where Sempra Energy’s subsidiary San Diego Gas and Electric paid out over $2 billion for fire damage. He has a wide insurance coverage and subrogation practice and can comment on the role of insurance in Carnival Corporation’s losses.
