Berger Kahn Attorney Published in Reuters and Westlaw Today in “Eyes On Me: Monitoring the Way Through Employee Privacy”

Berger Kahn Partner Erin Mindoro Ezra, and Associates Robert D. Chan and Ryan A. Johnson, discuss the increasing use of employee electronic monitoring due primarily to the continuing popularity of remote work, in their recent article “Eyes On Me: Monitoring the Way Through Employee Privacy.”

The conveniency of remote work benefits both employees and employers with flexibility, reduced real estate needs, and elimination of commuting times.  However, some monitoring practices employers have used raise concerns about employee privacy and the possible impact on overall job satisfaction.

This article highlights the delicate balance employers confront when engaging in monitoring practices.  To respond to employee privacy and job satisfaction concerns, employers will need to be able to show that the monitoring is substantiated and rooted in legitimate business purpose.
