Ted A. Smith practices in the firm’s Northern California office, handling complex civil litigation with an emphasis on insurance coverage, business and real estate. He has served as litigation counsel in state and federal courts throughout California and in other states, and has substantial experience in alternative dispute resolution and obtaining summary judgment.
Ted has defended insurance companies and risk management entities in a variety of actions challenging the interpretation of fire and casualty insurance policies, exhaustion of primary and excess insurance layers, procedures for the handling of claims, and coverage determinations under joint powers agreements for the pooling of self-insured claims. These cases have involved issues arising out of claims settlement practices regulations, the Unfair Competition Law, the federal bankruptcy acts, state and federal environmental acts, and the Unfair Insurance Practice laws.
Ted has also represented companies by conducting first-party investigations, conducting independent counsel fee audits, and providing formal coverage opinions.
In the business and real property area, his experience includes the representation of clients, as both plaintiff and defendant, in significant matters involving all aspects of contract litigation, construction defects, failures to disclose, mold contamination, and real property torts.
Ted is a member of the Sonoma County Bar Association and past President of the Board of Directors for Legal Aid of Sonoma County. In addition to being a successful trial lawyer, Ted runs, bikes and backpacks with his two young sons, and is known in his neighborhood as the gentleman farmer.
